Hey there , i saw an vid where somone had an custom weapon skin and custom emblem with VAC on it.

Somebody know where i can download skins or how to make some without getting banned?

You cannot get banned if you do it the right way. Later on i'll post up a skinning method in the Call Of Duty section that will show people how to do it the correct way.:D
