If I buy Modern Warfare 3 xRadar today will I be able to use it because its in Maintence?

Yes u are. But it's not 100% UD. It's a high Risk to get Banned. On Friday a Update will come.
I play with xinstanthook for css and mw2 since 2 days, I'm not banned yet. But maybe i will get banned in some day's i dont know.

Yes, maybe i get banned, maybe not. I dont care. :D Well, nobody knows if the hack is Detected or Not so.. yea, we have to wait.^^
